Mayor Robinson called the meeting to order at 9:02 a.m.

Staff reviewed instructions for members of the public to participate via Zoom, telephone, and how to contact staff for assistance if disconnected. It was noted that this meeting will be livestreamed to the West Grey YouTube channel.

Clerk Scharback advised that the purpose of the public meeting is to review applications for proposed amendments to West Grey Zoning Bylaw No. 37-2006, and to allow interested members of the public the opportunity to ask questions or offer comments with regard to the applications. Council will not make a decision on the applications at this meeting, based on the recommendations and information received at this public meeting amending bylaws may be presented for approval at a regular council meeting. 

A public registry is available by email at [email protected] and if any members of the public would like to be notified in writing of the decision on an application they are to provide their name and mailing address for the registry. This will also allow for notice of a Local Planning Appeal Tribunal if the decision of an application is appealed.

Planner Spencer recommends approval of her report. She noted that the purpose of the application is to change the zone symbol on the subject lands from C1 (general commercial) to R2-436 (residential with exception). The effect of which will change the zoning on the subject lands to permit the use of the lands for a five (5) unit residential building. Exception 436 will specifically permit the five (5) unit residential building and the requirement for site plan control.

Planner Spencer noted that comments were received from Grey County and not received from Saugeen Valley Conservation Authority. She confirmed that any concerns will be addressed through site plan control. She also noted that through record of site condition, the Ministry of the Environment, Conservation and Parks will indicate any environmental concerns, if any.

Gary Grainger, resident, inquired if policy allows for a five plex unit, and if five plex units are consistent with other parts of the county. Planner Spencer noted that the potential for a five plex unit will be reviewed through site plan control. She also noted that the province and county are encouraging municipalities to provide more affordable housing.

Andrew Watt, resident, inquired about the developer's plans to integrate a five plex unit into a single unit dwelling neighbourhood. Planner Spencer noted that site plan control will address parking and future development. Detailed drawings will be requested through site plan control.

Staff advised that after approval of a zoning bylaw amendment at a regular council meeting, there will be a twenty day appeal period. If no appeals are received in that time the applicant will be notified they may proceed with the site plan approval process.

Planner Spencer reviewed her report noting that due to the unique nature of the subject lands location a collaborative review of the applications is being conducted jointly with the County of Grey, Municipality of Grey Highlands and the Municipality of West Grey. A joint meeting to discuss comments and concerns has been established for early November.

Planner Spencer noted that Grey County's comments are accessible through the link in the report. Scott Taylor, Grey County's Manager of Planning, provided details regarding comments received:

  • Enbridge Gas Inc. noted no objections.
  • Grey County Transportation Services noted a review of the current intersections will be required.
  • Grey County Forestry & Trails noted no objections.
  • Municipality of Grey Highlands noted the traffic and infrastructure will have an impact and would like to be part of a joint review. They noted no planning concerns.
  • Saugeen Valley Conservation Authority noted no objections. Their comments included consistency with natural heritage and natural hazard area requirements and are working with the developer in this regard.

Councillor Townsend inquired about Grey County's involvement. Planner Spencer noted that Grey County is required to provide the amendment approval since the proposed expansion is outside of the defined settlement area of Markdale and West Grey.

Councillor Hutchinson inquired if a settlement area boundary adjustment will be required. Planner Spencer confirmed there is no intent for a boundary change.

Councillor Hergert inquired about the future development of the remaining land. Planner Spencer noted that future development of the remaining 6.6 hectare area would require review.

Ron Davidson, planning consultant with GM BluePlan, indicated that Chapman's requires the change to move forward with their factory expansion plans.

Shawn Cole, resident, inquired about traffic access via the highway. Planner Spencer indicated that the peer group is reviewing the best form of access.

Staff advised that once public and agency comments have been received, the peer review completed, and a planning analysis conducted a planning report will be brought back to a future council meeting.

Planner Spencer recommends approval of her report. She noted that the purpose of the application is to change the zone symbol on the subject lands from A2 (rural) to A2-436 (rural with exception). The effect of which will permit the use of the lands for an arts/culinary school.

Planner Spencer noted that comments from Grey County and Saugeen Valley Conservation Authority will be addressed through site plan control. 

Councillor Hutchinson inquired about the removal of the shed in the same potential location of the proposed new structure. Planner Spencer indicated that a site plane visit has been conducted and the complete zoning review will be conducted to ensure the new structure can be completed.

Councillor Hergert inquired about the capacity for the increased water requirements. Planner Spencer noted that a demonstration of sufficient water and sewer services will be required through the building application process.

Bev Falco, resident, indicated her support of the zoning amendment as presented.

She noted that the purpose of the application is to change the zone symbol on the subject lands from R2 (residential) to R2 (residential) and R2-437 (residential with exception). The effect of which will implement a condition of consent for file B21.2021 to recognize deficiencies in the retained parcel on the subject lands where the single detached dwelling unit currently exists.

Comments were received from Grey County and Saugeen Valley Conservation Authority after publication of the agenda noting no objections.

Cameron Gerber, owner of Cobblestone Diversions Inc. expressed his appreciation for working with West Grey.

Staff advised that after approval of a zoning bylaw amendment at the next regular council meeting, there will be a twenty day appeal period. If no appeals are received in that time the applicant will be notified they have fulfilled one condition of the provisional consent.

Planner Spencer recommends approval of her report. She noted that the purpose of the application is to change the zone symbol on the subject lands from A1 (agricultural) to A1-438 (agricultural with exception). The effect of which will permit the construction of a small-scale dry industrial use on the subject lands.

Comments were received from Grey County and Saugeen Valley Conservation Authority after publication of the agenda. Grey County indicated they cannot support the application as it is based on intentional use. SVCA noted support of the application.

Councillor Hutchinson inquired about the current house not being recorded as a structure in the application. Planner Spencer noted that the house is not considered part of the intended use. 

Councillor Hergert inquired about the meaning of the term dry industrial use. Planner Spencer explained that dry industrial use does not require a significant amount of water and is primarily related to farming use.

Councillor Townsend inquired if the county's concern is related to the windows in the building not being agricultural related. Planner Spencer confirmed the county's concern is with the windows and the potential to move towards a large commercial operation with higher traffic volume.

Staff advised that after approval of a zoning bylaw amendment at the next regular council meeting, there will be a twenty day appeal period. If no appeals are received in that time the applicant will be notified they have fulfilled one condition of the provisional consent and may proceed with the site plan approval process.

Planner Spencer recommends approval of her report. She noted that the purpose of the application is to change the zone symbol on the subject lands from A2 (rural), A3 (restricted rural) and NE (natural environment) to A3 (restricted rural), A3-349 (restricted rural with exceptions), NE (natural environment) and NE-440-h (natural environment with exceptions and a holding provision). The effect of which will implement a condition of provisional consent for files B11.2020, B12.2020, B13.2020, and B14.2020.

Planner Spencer noted that comments from Grey County and Saugeen Valley Conservation Authority were received through the consent application process. SVCA indicated their satisfaction provided the site plan control is registered with the property.

Councillor Hergert inquired if a there is a holding provision until the Environment Impact Study (EIS) is completed for two seasons and reviewed by Saugeen Valley Conservation Authority, and if there are any conditions remaining for the applicant to complete before the twelve month expiry. Planner Spencer confirmed there is a holding provision for the completion of the EIS. She noted that there site plan control is required after the twenty day appeal period and a survey and deeds are required for December 2022.

Councillor Townsend requested clarification of the process if the applicant does not complete the requirements by the deadline. Planner Spencer noted that the application would be deemed not approved and the applicant would need to reapply.
